Convalidation: Bringing Your Marriage Into The Church

Note: The following text is intended to give a basic overview of the convalidation process. Because every couple’s situation is unique and because practices related to the implementation of the process may vary from diocese to diocese, persons interested in pursuing a convalidation and/or a declaration of nullity should speak with their parish priest or a professional at the local Tribunal.

Is my Marriage Recognized by the Church?
Like other couples in your parish or family, you may be wondering if your marriage is fully recognized by the Catholic Church. Catholic Church law ordinarily requires baptized Roman Catholics to marry before a priest or deacon. Unless they received a “dispensation from canonical form,” Catholics who exchange vows in the presence of ministers from other religious traditions or civil officials are not considered validly married in the eyes of the Catholic Church.

Regardless of what happened in the past, the Catholic Church invites you to bring new meaning to your lives by embracing the vocation of marriage and dedicating your family’s mission to sharing God’s love.

Why Marry Catholic?
Catholic Marriage is unique among other marital relationships because it is a sacrament that makes Christ present in our world. The relationship between husband and wife mirrors the relationship of Jesus Christ for his people. In the Catholic tradition, husband and wife accept a role in God’s plan for humanity. They are ambassadors of God’s love, and they collaborate with God to keep humanity alive.

The vows exchanged by the couple are a sacred pact through which the spouses embrace each other, and, together, embrace Jesus as their partner. Through their union with Christ they participate in the unbreakable pact between God and humanity: the covenant that was sealed in the death and resurrection of Christ.

Benefits of Catholic Marriage
One of the many benefits of a sacramental marriage is the power of God’s grace, which helps couples keep their commitment and find happiness together. Social scientists are finding that couples who recognize God’s presence in their relationship experience more satisfaction and are more likely to achieve lifelong marriage.

All in all, couples who choose to bring their marriage into the Church receive many gifts – peace of heart, oneness with the Church, the fullness of the sacraments, and God’s special blessing upon their marriage.

What if there is a Prior Marriage?
In the simplest terms, if a Catholic wishes to marry in the Church when there has been a previous marriage for either party, the partner in the earlier union must have died or the Church must have issued a declaration of nullity (frequently called an annulment) of the previous marriage.

The Catholic Church views all true marriages with respect. It presumes that they are valid. Thus, it considers the marriage of two Protestant, Jewish or even non-believing persons, any of whom marry according to their own tradition, to be binding in the eyes of God. Consequently, a tribunal process is required to establish that an essential ingredient in the relationship was missing from the start of the previous marriage.

For Catholics with a prior marriage outside the Church, the declaration of nullity is based on what is called a “lack of canonical form.” For Catholics with a prior “valid” marriage, the tribunal process is termed a “formal case.” Catholics should consult with their pastor if a declaration of nullity is needed.

Three Things that Make Marriage Valid in the Church
Three things need to be in place for a true (valid) marriage: capacity, consent, and canonical form. A valid Catholic marriage comes into existence when a man and woman who are capable, give consent to a true marriage, including all the essential properties of marriage, and exchange this consent in the proper form for Catholic weddings.

Convalidation is not simply a “blessing” of an existing union. It requires that a new, free act of consent be made.

Capacity

  • Psychological capacity (emotional maturity and stability)
  • Physical capacity
  • Freedom from impediments (e.g. a prior marriage, vows in a religious order, etc.)

Consent

  • To a lifelong marriage
  • To an exclusive marriage
  • To a marriage that is open to children

Canonical Form

  • To be married in the presence of a Catholic bishop, or a priest or deacon delegated by either the pastor or bishop, and two witnesses according to the Order of Celebrating Matrimony.

NOTE: Special permission is required for Catholics to marry in a place other than their parish church.

Ten Steps toward Convalidation:

  1. Contact your local parish for an appointment with your pastor or his delegate to discuss the situation and determine what must be done.
  2. Obtain a new copy of the baptismal certificate for the Catholic party (or parties). Make that request to the parish where the person was baptized. If the parish no longer exists or baptismal records are unavailable, contact the Chancery office of that Catholic diocese for assistance.
  3. Begin collecting the necessary paperwork for the Pre-Nuptial Investigation.
  4. Participate in formational sessions with a mentor couple, priest or deacon in the parish to prepare you for sacramental marriage; take a Natural Family Planning Class (http://www.usccb.org/issues-and-action/marriage-and-family/natural-family-planning/find-an-nfp-class.cfm).
  5. If there is a prior marriage for either party, seek a Church declaration of nullity.
  6. As part of your formational sessions, you may be asked to complete a premarital inventory to identify strengths and areas for growth in the relationship.
  7. If married civilly two years or less, attend a parish or diocesan marriage preparation program (some examples listed here); if previously married, discuss with the priest or his delegate options for specialized preparation.
  8. If married more than two years it is highly recommended that you attend a marriage enrichment weekend or event (some examples listed here).
  9. Determine the date and most suitable type of ceremony. For two Catholics, a nuptial Mass is suggested so that the first meal shared by the couple is the Eucharist, the source and summit of our faith. Plan a joyful get-together that will follow the liturgical service to celebrate the Church’s recognition of your marriage.
  10. Celebrate the Sacrament of Reconciliation and become actively involved together in your parish community.

Making Multicultural Relationships Work: Our Experience as a Chilean-American Couple

On one particular day in October 2011 (I am not sure of the precise date), I was making my way to class at the Pontifical Catholic University in Santiago, Chile, where I was studying abroad for a semester. The class was held in room N2 in one of the university’s central buildings, a ‘California style’ classroom complex with all the doors facing out to the open air. I took my seat in the second row where I sat next to the other American students, two boys and two girls from the University of Notre Dame. At the beginning of each lecture, the teacher would silence the pre-class chit chat and take attendance, but on that particular day he was occupied with another task in the first couple minutes of class. So the professor delegated the attendance to an agronomy major, Juan, with whom he had been talking before class about his farm in southern Chile. Juan had black hair, tanned skin, and stood about 5’7” tall, and as he sat at the teacher’s desk calling off the list of names, I remember thinking that he had the most wonderful deep baritone voice. Today I hold this memory dear to my heart as the first time I remember seeing and hearing the man I am going to marry.

I have always liked the phrase, “If you want to hear God laugh, tell him your plans.” In Chile they have a similar phrase, “Uno propone, Dios dispone” which means something like “Man suggests, God decides.” At that point in my life, I had no idea how true those words would become. I certainly never planned on marrying someone from another country. And yet several weeks later, Juan and I went on a date, salsa dancing, after which he walked me back to my apartment as we talked and talked. We started studying for class together and going on long walks, and our conversation would turn from to what we were interested in and our thoughts on life and faith. We began to realize that this might be for real. Even though we had no idea what the future might hold, with a little faith and a lot of discernment we decided that we would continue discerning a life together despite the long distance and obvious challenges that our relationship presented. And so, after the 11:00 Sunday mass on my last day of the semester abroad, we said goodbye with no fixed plans to see each other again but a certainty God was not yet done with us.

My plans to study more than one semester at the Pontifical and eventually do my Master’s in Linguistics at the University of Chile (which is what I’m doing now) made our relationship possible, albeit with lots of time as a long, long, long distance couple. Juan visited my home in Wisconsin and met my family a year ago. This past April, 2 years and 5 months after we met, he asked me to marry him. Needless to say, I said yes.

The story of how God calls two people to marriage is always beautiful and is unique for every couple. Our story has certainly been unique. At times I have wondered why God would call us to marriage if we are from such different places. Then again, why wouldn’t he? If there is one thing I have learned in my life over the past five years, it is that God has a habit of surprising his followers with plans far more wonderful and challenging than they would ever have made for themselves.

As I reflect on our journey, I would like to talk a little bit about one aspect of our relationship that is not so unique, which is that fact that Juan and I technically speaking are what one might call a multiracial/multicultural couple. I’m not a fan of the label, but the situation it describes is becoming more and more common given the diversity of the United States. Cultural differences, like any other differences we bring to a relationship, can present their own blessings and challenges. There is often a greater need for communication about topics which are taken for granted when you share the same cultural background. It is important to learn about the culture of your significant other, and to make sure you talk about things like: How are gender roles different in your respective cultures? How are children raised? What is the role of extended family? What are politics like? Which values are most important in your respective cultures? And most importantly, how does your significant other feel about these aspects of their culture? After all, we do not adhere to everything our culture dictates. As practicing Catholics, Juan and I find that our values and worldview are often profoundly countercultural in the both the United States and Chile.

Communication, as in any relationship, is very important. Hopefully an engaged couple shares the same values of faith and family. When little issues do arise, which can often stem from cultural differences, be willing to try and understand where your significant other is coming from and to know the difference between non-negotiable values and cultural preferences.

And these little issues will arise. For example, we still haven’t decided what to do about my last name when we marry. According to my cultural traditions, I would take Juan’s last name. But according to Hispanic tradition, I would keep my last name and our children would have two last names, first Juan’s paternal last name and then mine. There are also other issues that we will need to discuss when we have children. In Chile, for example, babies are often not baptized until they are over one year old. I prefer Baptism at a few months, as is typical in the U.S. Besides timeline difference like that, there are also often differences across in the types of educational systems. For example, when I first brought up the idea of potentially homeschooling, this was a completely foreign concept for Juan, as homeschooling is almost non-existent in Chile. And of course there is a language issue. I am the only Spanish-speaker in my family and Juan is the only English-speaker in his, so it will be a priority for us to make sure our children speak both Spanish and English fluently. How we go about doing that will surely be a topic of discussion down the road.

When one person in a relationship is not just from another culture but is also an immigrant, or will be, this can add a new level of stress to the relationship. Juan and I are currently in the process of making decisions about where we are going to live and how and where we are going to pursue our careers while prioritizing our family. Sometimes I worry about Juan facing discrimination in the United States or my children not getting as good an education in Chile. Decisions like these are stressful and incredibly complex, as they will have a tremendous impact on our future. Juan and I try to approach everything with as much openness and honesty as possible, as well as with a lot of prayer and discernment. While these decisions are very stressful, Juan and I have found that they also increase our intimacy as a couple, as they require a lot of in-depth and frank conversations about what we want out of life and how we believe we are called to live out our vocation.

Despite the challenges, multicultural relationships can also be incredibly enriching, so I would leave you with this little piece of advice: Celebrate the best of both cultures. Learn to cook the food, speak the language, and have fun celebrating the holidays and traditions of each. Also, being exposed to how different cultures express their faith can enrich your own. For example, my exposure to Chilean Catholicism has certainly deepened my relationship with Mary.

Finally and most importantly, while I’m very proud to be an American, and Juan Chilean, at the end of the day our true heritage is in Christ, and our citizenship is in heaven.

Things You’ll Wish You Knew Before ‘I Do’

One of my favorite parts of my engagement to my fiancé George, (whom I met on CatholicMatch), came after I said, “Yes.” In the days and weeks following that sunny Saturday in June, treasured nuggets of information began to trickle out from our family and friends, cluing me into the behind the scenes planning that led to George on bended knee.

For weeks, my laid-back then-boyfriend carefully crafted a proposal involving our closest family and friends. From contacting my best friend and her husband to take photos and video footage to coordinating an engagement party at one of our favorite restaurants and swearing everyone to secrecy, he planned every detail, including the perfect location—under the iconic arches at our shared alma mater.

He was intentional and purposeful as he prepared to ask me to be his wife, even incorporating details from my carefully-laid hints during our courtship. Perhaps subconsciously, George was setting the foundation for our time as an engaged couple preparing for the sacrament of marriage and later, our journey as husband and wife.

We’re approaching this life-changing commitment in a different way than many of those around us. I’ve posted before about our wedding plans from choosing the venue to booking our honeymoon, but at the core of each of these choices is a focus on why we’re doing each of these things.

I’m called to be George’s wife and he’s called to be my husband. That’s a reality that goes beyond each of us, and we still do not know exactly what impact our union will have on each other, those around us and the rest of the world. What I do know is that we’re intentionally creating a marriage, not a wedding, through each month leading up to “I do.”

We’re intentionally doing marriage prep. Intentionally not cohabitating. Intentionally planning the wedding Mass. Intentionally planning a life based on faith.

Weddings are commonplace in our society, but not marriages. Among my peer group, I hear many reasons of why couples get married, and in so many instances, they accidentally fall into married life because of outside circumstances and not the prompting of the Holy Spirit. For some, they’re living together already and presume marriage is the next logical step in life. For others, they’re struggling with finances individually and hope that two combined incomes are better than one. Or maybe they just think they’re at the age where they should be married. And so they move forward, promising “‘til death do us part” at a wedding ceremony that they happen to be a part of.

Catholic writer Matthew Warner wrote about accidental living in a recent issue of the magazine Shalom Tidings:

“You were made to live intentionally. You were made to choose how you live your life, not to let life simply happen to you…If life is just happening to you, then you are caught up in the mire and mediocrity of accidental living. An accidental life will never be fulfilling to a creature that was made to choose.”

Just as we were made to choose a life that honors God, we were made to make intentional choices in all other aspects of life, including whom you marry. Living an intentional life is not taking the reins and being in control of every detail of your life. It’s choosing to allow God into your heart to guide you in all of your actions and decisions.

In our careers, we don’t expect promotions to get handed to us. We have to make a series of choices to prove ourselves along the way. You don’t accidentally find yourself in a dream career, even if every stepping stone magically aligned in the perfect way.

The same applies for relationships. You don’t accidentally find yourself in a happy, spiritually-centered marriage. You have to intentionally choose to search for the spouse God has planned for you (like by joining CatholicMatch!) and then live that call out with purpose.

Addressing volunteers at World Youth Day, Pope Francis encourages all of us to fight against the temptation of accidental living to not only follow God’s plan for each of us, but to live a life of happiness:

“God calls you to make definitive choices, and He has a plan for each of you: to discover that plan and to respond to your vocation is to move forward toward personal fulfillment…Have the courage to swim against the tide. And also have the courage to be happy.”

When a Man Likes a Woman: 5 Do’s

In my then-boyfriend’s apartment, I smiled while I quietly asked a question:

“What crossed your mind the first time you saw me?”

He thoughtfully paused, and aligned his eyes with mine, before he answered without blinking (and, apparently, without thinking):

“I want a piece of her.”

You want a piece of me? The line led to fightin’ words, words that build walls between a woman and a man, which—in that case—was for the best. But the line also led to a realization: When a man likes a woman, he doesn’t do what that guy did (including but not limited to “objectify her”). So what should a guy do when he likes a girl? I’ll tell you:

1. Ask questions. Few pursuits bear less fruit than those of men who desire to find and marry the right woman but refrain from asking women questions. A woman needs to know who you are, but a woman also needs to know that you want to know who she is. We are generally delighted by a good guy’s desire to tell us about his life, but a guy who shares information and doesn’t solicit it does a disservice to a potential relationship. If a man likes a woman, he ought to ask what her goals are, and what she values, and how into comics she is before he lists all the titles in his collection. A man who doesn’t ask a woman questions sends a sign that he isn’t interested in her.

2. Use words. It is equal parts liberating and alarming to acknowledge this important truth: we can’t not communicate. A person says as much by not talking as he or she does by speaking up. But there is a big gap between somebody who doesn’t talk and somebody who does. A guy who crosses his arms, audibly sighs, and rolls his eyes over and over when he is frustrated speaks in code. A guy who tells his date he is frustrated is a grown-up. A woman can’t read anybody’s mind but her own, and a man who doesn’t give her a reason to try to read his is a man who spares her stress. By default, human beings constantly communicate. But when a man likes a woman, he uses words to do it.

3. Seek counsel. Dating is hard. Dating is potentially harder when half a couple seeks advice from somebody who isn’t qualified to give it. When a man likes a woman and needs advice, he considers a person’s credentials before he solicits it. If he wants to know what a woman meant by what she said, he doesn’t poll his friends; he asks her. If he isn’t sure he knows what his vocation is, he doesn’t tweet about it; he meets with a spiritual director. If he struggles to practice chastity, he doesn’t vent to his single but sexually active friends; he asks his friends who are good at chastity to hold him accountable. A man’s respect for a woman and his relationship with her is evident when he seeks counsel about it wisely.

4. Follow through. Actions indeed speak louder than words, but that doesn’t mean what somebody says is irrelevant. When a man likes a woman, he does what he says he’s going to do, and in doing so, he proves he is worthy of her trust. If he tells her he’ll text her, or call her, or DVR a How I Met Your Mother re-run for her, he gives her an expectation. But a man who gives a woman an expectation and then does not fulfill it gives her a reason not to trust him.

5. Save sex. A practicing Catholic woman expects a man to believe before he pursues her that preparedness for marriage is more important than preparedness for a wedding night. As Catholics, we are not called to have sex because sex is pleasurable. We are called to create a pleasurable sexual relationship with the person to whom we are united in marriage.

Marriage, a vocation, is designed to result in the destruction of self-absorption. Saving sex while we date aligns us with that purpose. When a man likes a woman, he does what he can to prepare for the patience, sacrifice, and self-denial that a marriage will require—and saving sex is an exercise in all three.

Ecumenical and Interfaith Marriages

Until recent decades, the idea of a Catholic marrying outside the faith was practically unheard of, if not taboo. Such weddings took place in private ceremonies in the parish rectory, not in a church sanctuary in front of hundreds of friends and family.

These days, many people marry across religious lines. The rate of ecumenical marriages (a Catholic marrying a baptized non-Catholic) and interfaith marriages (a Catholic marrying an non-baptized non-Christian) varies by region. In areas of the U.S. with proportionately fewer Catholics, as many as 40% of married Catholics may be in ecumenical or interfaith marriages.

Because of the challenges that arise when a Catholic marries someone of a different religion, the church doesn’t encourage the practice, but it does try to support ecumenical and interfaith couples and help them prepare to meet those challenges with a spirit of holiness. Theologian Robert Hater, author of the 2006 book, “When a Catholic Marries a Non-Catholic,” writes: “To regard mixed religion marriages negatively does them a disservice. They are holy covenants and must be treated as such.”

A marriage can be regarded at two levels – whether it is valid in the eyes of the Church and whether it is a sacrament. Both depend in part on whether the non-Catholic spouse is a baptized Christian or a non-baptized person, such as a Jew, Muslim or atheist.

If the non-Catholic is a baptized Christian (not necessarily Catholic), the marriage is valid as long as the Catholic party obtains official permission from the diocese to enter into the marriage and follows all the stipulations for a Catholic wedding.

A marriage between a Catholic and another Christian is also considered a sacrament. In fact, the church regards all marriages between baptized Christians as sacramental, as long as there are no impediments.

“Their marriage is rooted in the Christian faith through their baptism,” Hater explains.

In cases where a Catholic is marrying someone who is not a baptized Christian – known as a marriage with disparity of cult – “the church exercises more caution,” Hater says. A “dispensation from disparity of cult,” which is a more rigorous form of permission given by the local bishop, is required for the marriage to be valid.

The union between a Catholic and a non-baptized spouse is not considered sacramental. However, Hater adds, “Though they do not participate in the grace of the sacrament of marriage, both partners benefit from God’s love and help [grace] through their good lives and beliefs.”

Marriage Preparation

Good-quality marriage preparation is essential in helping couples work through the questions and challenges that will arise after they tie the knot.

Questions that the engaged couple should consider include in what faith community (or communities) the couple will be involved, how the couple will handle extended family who may have questions or concerns about one spouse’s faith tradition, and how the couple will foster a spirit of unity despite their religious differences

Of all the challenges an ecumenical or interfaith couple will face, the most pressing one likely will be the question of how they raise their children.

“The church makes clear … that their marriages will be more challenging from the perspective of faith,” Hater writes. “… Special challenges exist as well when it comes to raising children in the Catholic faith.”

Because of these challenges, the church requires the Catholic party to be faithful to his or her faith and to “make a sincere promise to do all in his or her power” to have their children baptized and raised in the Catholic faith. This provision of the 1983 Code of Canon Law is a change from the 1917 version, which required an absolute promise to have the children raised Catholic.

Likewise, the non-Catholic spouse is no longer required to promise to take an active role in raising the children in the Catholic faith, but instead “to be informed at an appropriate time of these promises which the Catholic party has to make, so that it is clear that the other party is truly aware of the promise and obligation of the Catholic party,” the code states. (See the 1983 [current] Code of Canon Law, canons 1124-1129 on “Mixed Marriages” for the full text.)

But suppose the non-Catholic party insists that the children will not be raised Catholic? The diocese can still grant permission for the marriage, as long as the Catholic party promises to do all he or she can to fulfill that promise, Hater writes. The marriage may be legal, he notes, but is it a wise choice? Those are questions that may also need to be explored in marriage preparation.

If children are raised in another faith, he notes, “the Catholic parent must show children good example, affirm the core beliefs of both parents’ religious traditions, make them aware of Catholic beliefs and practices and support the children in the faith they practice.”

The Wedding Ceremony

Because Catholics regard marriage as a sacred event, the church prefers that ecumenical interfaith couples marry in a Catholic church, preferably the Catholic party’s parish church. If they wish to marry elsewhere, they must get permission from the local bishop. He can permit them to marry in the non-Catholic spouse’s place of worship or another suitable place with a minister, rabbi or civil magistrate – if they have a good reason, according to the U.S. Conference of Catholic Bishops. This permission is called a “dispensation from canonical form.” Without it, a wedding not held in a Catholic church is not considered valid.

It’s popular, and acceptable, for an ecumenical or interfaith couple to invite the non-Catholic spouse’s minister to be present at the wedding. But it’s important to note that, according to canon law, only the priest may officiate at a Catholic wedding. A minister may offer a few words, but he or she may not officiate or preside at a joint ceremony.

It is generally recommended that ecumenical or interfaith weddings not include Communion. Therefore, most ecumenical or interfaith weddings take place outside of Mass: there is a different service for a Catholic marrying a baptized Christian and a Catholic marrying a non-baptized person or catechuman (person preparing for baptism).

“The reception of Communion is a sign of unity with the ecclesial community,” he explains. “On a wedding day, the fact that one-half of the congregation does not belong to the Catholic community [and, hence, does not receive Communion] cannot be a sign of welcome or unity on a couple’s wedding day.” It might be “likened to inviting guests to a celebration and not allowing them to eat,” he adds.

If an ecumenical couple wants to celebrate their wedding within Mass, they must get permission from the bishop, Hater says. “In addition, only with his permission can a person, other than a Catholic, receive Communion in church during such a wedding.”

Catholic-Jewish Weddings

Jews and Christians share a view of marriage as a holy union and symbol of God’s bond with his people.

Stricter branches of Judaism, such as Orthodox and Conservative, forbid or strongly discourage Jews from marrying non-Jews and prohibit their rabbis from participating in interreligious marriage ceremonies.

“Conservative Judaism sees only the marriage of two Jews as … a sacred event,” reported the USCCB’s Committee for Ecumenical and Interreligious Affairs, which discussed Catholic-Jewish marriages at a conference in November 2004. The Reform branch of Judaism strongly discourages interfaith marriages, but there is no legal prohibition against it as there is in the stricter branches.

Often, a Catholic-Jewish wedding is held at a neutral site – with permission from the bishop – so that neither family will feel uncomfortable. In such cases, a rabbi is likely to officiate. The couple needs to have a dispensation from canonical form for such a wedding to be valid in the Catholic Church.

“Your pastor could be involved in the wedding by giving a blessing, but in Catholic-Jewish weddings, usually the rabbi will officiate,” writes Father Daniel Jordan, judicial vicar for the Tribunal of the Diocese of Burlington, Vt.

As for the children of a Catholic-Jewish marriage, religious leaders agree that it is “vastly preferable for the offspring of mixed marriages to be raised exclusively in one tradition or the other, while maintaining an attitude of respect for the religious traditions of the ‘other’ side of the family,” the conference report said.

Traditionally, Jews consider any child of a Jewish woman to be Jewish. The question of what faith in which to raise children must be an ongoing topic of dialogue between the couple and during marriage preparation. “Attempting to raise a child simultaneously as both Jewish and Catholic … can only lead to violation of the integrity of both religious traditions,” the report said.

Catholic-Muslim Marriages

Marriages between Catholics and Muslims present their own particular challenges.

Islamic men may marry outside of their faith only if their spouse is Christian or Jewish. In fact, the prophet Muhammed had a Christian wife and Jewish wife. A non-Muslim wife is not required to adopt any Muslim laws, and her husband cannot keep her from attending church or synagogue. However, Islamic women are forbidden from marrying non-Muslim men unless the spouse agrees to convert to Islam.

For Catholics and Muslims, one of the most difficult aspects of marriage is the religion of the children. Both faiths insist that the children of such marriages to be part of their own religious faith.

Such issues will continue to be challenges for Catholics marrying outside the faith in this increasingly diverse world, Hater writes. But with positive approaches to preparation and ministry, and a spirit of welcome to both parties, many ecumenical and interfaith marriages can be intimate, holy reflections of God’s love.

“Regarding mixed marriages with hope does not minimize the challenges that they present,” he says, “but recognizes the blessings that they can afford to spouses, children and the faith community.”

Cohabitation

It’s no secret that many couples are cohabiting, that is, living together in a sexual relationship without marriage. Currently, 60% of all marriages are preceded by cohabitation, but fewer than half of cohabiting unions end in marriage.

Many couples believe-mistakenly-that cohabitation will lower their risk of divorce. This is an understandable misconception, since many people are the children of divorce, or have other family members or friends who have divorced. Other reasons for living together include convenience, financial savings, companionship and security, and a desire to move out of their parents house.

What social science says about cohabitation

  • On average, marriage preceded by cohabitation is 46% more likely to end in divorce.
  • The risk is greatest for “serial” cohabitors who have had multiple relationships.
  • Some studies indicate that those who live together with definite plans for marriage are at minimal risk; however, there are no positive effects from cohabiting.
  • Cohabitation puts children at risk. Forty percent of cohabiting households include children. After five years, one-half of these couples will have broken up, compared to 15% of married parents.

Cohabitation and Catholic Church teaching

Every act of sexual intercourse is intended by God to express love, commitment and openness to life in the total gift of the spouses to each other. Sexual intercourse outside of marriage cannot express what God intended. Rather, it says something false–a total commitment that the couple does not yet have. This total commitment is possible only in marriage.

The Catechism of the Catholic Church points out that some couples claim a right to live together if they intend to marry later on. Although the couple may be sincere in their intention, the Catechism stresses that human love is not compatible with “trial marriages.” Rather, “it demands a total and definitive gift of persons to one another.”

Cohabitation and marriage preparation

If you are a cohabiting couple who has chosen to marry, the Catholic Church welcomes your decision to marry. Because cohabitation can have an effect on the marriage, couples are encouraged to explore certain questions with the pastoral minister who is preparing them for marriage. These include:

  • Why did you choose to live together?
  • What did you learn from the experience of living together?
  • Why did you decide to marry?
  • Why do you wish to marry in the Catholic Church?
  • What does marriage as a sacrament mean to you?

Pastoral ministers may encourage cohabiting couples without children to separate for a period before marriage as a sign of their free, loving decision to follow the Church’s vision of marriage and sexuality. Couples are also encouraged to receive the Sacrament of Reconciliation.

People have a right to marry; therefore, cohabiting couples cannot be denied marriage in the Catholic Church solely because they are cohabiting. However, cohabitation may raise questions, for example, about the couple’s freedom to marry, that need to be explored.

Common Values

My husband and I have been married 35 years and have led marriage preparation programs for 30 of those years. We estimate that over that time we’ve prepared over 5,000 couples for marriage. I’m not sure if that makes us experts or outdated and, therefore, irrelevant. I can tell you the obvious – that times have changed and we have changed.

Early in my career, when I taught high school or college students about marriage, I’d say that communication was the key in choosing a mate and keeping a marriage healthy. I’ve changed my mind.

Good communication is not enough

Yes, good communication is essential to a thriving marriage, BUT, it is not sufficient and probably not the most important criteria for choosing a mate. I say this because in my counseling I repeatedly came across couples who had learned the right communication skills and could use them. They knew how to use “I statements,” listen to the whole person, and use active listening. They were often fine, caring men and women, but they had serious difficulty living together happily- not at the beginning, but after several years.

The bottom line often came down to either very different personalities or very different values. The other significant variable was the inability of at least one partner to make a lasting commitment.

Personalities cannot easily be changed, so it’s a red flag when dating couples have very different personalities. Complementary personalities, however, can also be an advantage. For example, she’s a talker, he’s a listener; or he’s a detail person, she sees the big picture. Often people with different personalities can work out accommodations as long as the difference is not too extreme or on too many different fronts. I tell my students that it’s fine to differ on one or two elements of the Myers- Briggs Type Indicator, but if you differ on three or four and the differences are great, you’ll probably have a lot of stress in your marriage.

Common values, however, can be a deal breaker. If one spouse values a simple lifestyle and the other values accumulating wealth, it doesn’t matter how well they communicate, their basic life orientation will present constant opportunities for conflict. If one spouse values faith and the other resents religion, conflict is inevitable. This doesn’t mean that both spouses have to have the same religion, but both must value a spiritual dimension of life.

Another important common value is one’s attitude towards having children. One partner may really want children and feels marriage would not be complete without a child, while the other is ambivalent or, worse, thinks children would impinge upon their lifestyle. Good communication can only clarify this difference, not solve it.

Likewise, if one spouse believes that career is the top priority and the other puts family first, the argument will be eternal- either by outward criticism and fighting or by going underground with general dissatisfaction or depression. Whether one spouse should stay home with young children is a subcategory of this issue.

Different beliefs about respect for human life and other moral values are deeply rooted. Getting new information and talking through differences usually only lead spouses to realize that they have vastly different life goals and values. These will not change without violating one’s integrity and conscience.

Yes, communication is vital, and if couples don’t have good communication skills, learning them can be a marriage saver. But if the values are significantly different, it’s unlikely that even the best communication will be enough.

Is it too late?

This is fine, you may say, for engaged couples who have not yet made a marriage commitment, but what about us married couples? Is it too late? Can value differences be fixed or changed? The answer is that prevention is always preferable but seldom is a situation hopeless. A lot depends on the severity of differences and whether there are compromises that both spouses can tolerate.

I would never want a spouse to violate his/her conscience in order to please a mate, but sometimes one spouse may be too scrupulous. Over time they may learn that not everything is black and white. On the other hand, a spouse who rationalizes away ethical decisions, saying they are unimportant, may, with commitment and effort, develop a more sensitive conscience. It’s not easy, though, since these are life long behavioral patterns.

Sometimes a couple can agree to disagree on a few values and live their lives in different spheres. For example, one night a week she goes to a prayer group and he plays his favorite sport. He supports her and does not interfere with her Sunday worship, even though he doesn’t find it important for himself.

Most serious value differences require counseling. That’s the bottom line.

Try a short exercise to determine how close you and your spouse are on basic marriage values.

COMMON VALUES ASSESSMENT

Circle the values that are most important to you. Consider that some values may initially appeal to you but upon deeper reflection (the statement that follows each value) you realize that you don’t always hold them as a priority. Then rank them in importance from 1-14. Discuss with your fiancé(e) or spouse.

1. Honesty. Yes, but sometimes it’s OK to fudge.

2. Commitment. Sure, but some commitments are just too hard to keep.

3. Fidelity. I don’t plan on having an affair but who knows the future.

4. Loyalty. It might be necessary to violate a loyalty if another’s safety is at risk.

5. Devotion to parents. Parents are important, but spouse comes first.

6. Generosity. I’ll give, but only after I’ve taken care of myself.

7. Peacemaking. Sometimes evil needs to be confronted, even with violence.

8. Living simply. I work hard for my money. Why can’t I enjoy its rewards?

9. Kindness. Some people are too kind and others take advantage of them.

10. Self-control. I believe in being flexible and spontaneous, not being uptight.

11. Education. Education is over-rated. I wouldn’t sacrifice current wants for it.

12. Sacrifice. Suffering and delayed gratification have no use and are to be avoided.

13. Friendship. Friends are nice, but family and spouse are more important.

14. Children. I value my freedom more.

Conflict Resolution

Communication usually comes easily and smoothly to most engaged couples. They can talk to each other about just anything. It may even be hard to understand how or why married couples fight. You may say to yourselves, “We’ll never be like that.” And maybe you won’t.

On the other hand, you may have already had some quarrels and worry about how to get through these times more smoothly in the future. Wedding planning can bring up all kinds of new areas that spark disagreements.

What you are experiencing is normal for your relationship stage. The challenge is not to avoid conflict but to learn to use it to clear the air. Through it all, you’ll want to love and respect each other.

Even as two people grow close together, they will occasionally think differently and have different opinions on how to handle a situation. If this doesn’t ever occur, it is likely that one partner is avoiding a confrontation, submerging his/her identity, or always giving in. That’s not healthy for marriage over the long haul.

Intimacy / Cohabitation

As a courting or engaged couple, you have probably discussed where to draw the line about sexual intimacy before marriage. The Catholic Church teaches that every act of sexual intercourse is intended by God to express love, commitment and openness to life in the total gift of the spouses to each other. This total commitment is possible only in marriage.

As you move towards marriage, it’s important to make sure that sexual intimacy builds on other kinds of intimacy and does not short circuit your knowing each other on many levels.

What are those other levels? John Van Epp, Ph.D. explains in his book, How To Avoid Marrying a Jerk, that a healthy sexual relationship comes in stages of bonding:

  1. Knowledge of the other beyond the superficial
  2. Trust in the other to be a person of integrity
  3. Reliability of the other to be a person you can count on
  4. Commitment to the other that is not temporary
  5. Sexual Touch in which you give yourself fully to your beloved

Van Epp says the order is important. Couples should “never go further in one bonding area than you have gone in the previous.” The risk of disappointment and going beyond your safety zone will not bring you lasting happiness.

Steps leading to sexual intimacy, however, are not the whole of what intimacy is about. Long-married couples know that intimacy includes so much more than just the physical. The emotional intimacy of being able to share your most private and cherished thoughts is a pre-requisite for a fulfilling marriage. Knowing that you can be vulnerable and your spouse will not use sensitive information to hurt you is another form of intimacy. Realizing that your relationship does not depend on looks, talent, success, or perfection is a kind of intimacy that money cannot buy.

What about couples who live together before marriage? How does this impact a future marriage and ability to be intimate on more than just the sexual level? Given the high divorce rate, it would seem logical to live together before marriage in order to know your partner more fully.

As intuitive as this assumption sounds, current research does not bear it out. Studies (Whitehead and Popenoe, 2002) show that:

  • Women in cohabiting relationships, and their children, are more likely to be abused.
  • Cohabiting couples have lower levels of happiness and wellbeing compared to married couples.

Why does living together before marriage to prevent divorce end up harming one’s marriage? The answer has to do with the dynamics of commitment. Cohabiting before marriage generally means that at least one partner is not ready to commit to a permanent relationship. One or both partners are holding something back. They might be censoring their words and actions to put their best foot forward, lest they lose the relationship. In other words, what you see may not be what you end up getting. Communication may not be completely honest. For example, the couple may avoid sensitive subjects that they fear will disturb the relationship. One partner may give in unduly out of fear that the other will leave.

Another pitfall of cohabiting is “low commitment/high autonomy” relationships. This means that since the couple’s commitment to each other is not yet complete, each retains a degree of independence in the relationship. The longer this pattern continues the harder it is to make the transition to the high commitment needed for marriage.

Does this mean that cohabiting couples are doomed to misery and divorce? No, but it does give the thoughtful person cause to pause and re-evaluate. Whitehead and Popenoe recommend the following:

  • Consider not living together at all before marriage. There is no evidence that cohabitors who eventually marry will have a stronger marriage than those who don’t live together. Instead, they may be at greater risk for divorce. Some studies indicate that those who live together with definite plans for marriage are at minimal risk; however, there are no positive effects from cohabiting.
  • Do not make a habit of cohabiting. Be aware of the dangers of multiple living together experiences. Contrary to popular wisdom, multiple cohabiting experiences do not teach one how to have better relationships.
  • Understand the danger of lengthy cohabitation. The longer you live together with a partner, the more likely that the low-commitment ethic of cohabitation will take hold, the opposite of what a successful marriage requires.
  • Do not cohabit if children are involved. Cohabiting parents break up at a much higher rate than married parents. Moreover, children living in cohabiting unions with stepfathers or mothers’ boyfriends are at higher risk of sexual abuse and physical violence.

Children & Parenting

On their wedding day, the bride and groom are asked: “Will you accept children lovingly from God and bring them up according to the law of Christ and his Church?” Dreaming together about the children you hope to have is one of the most exciting parts of getting married. However, unless you’re entering a step-parent family or already have children, the nuts and bolts of daily parenting are probably not high on your radar screen. Here’s a suggested list of items that couples should discuss before they get married regarding children and parenting. See if you’ve covered most of them.

Childbearing

  • Do we both want to have children? [Note: Because the Catholic Church teaches that marriage is ordered toward the union of spouses and the procreation and education of children, if one or both spouses intend never to have children (as opposed to postponing pregnancy for a just reason), the marriage could be considered invalid.]
  • Do we hope to have children right away? What are the financial, educational, or medical factors that could affect this decision?
  • If we are hoping to postpone pregnancy, do we both accept the Catholic Church’s teaching that contraception is immoral? If not, are we willing to learn more about what the Church teaches and why?
  • Are we familiar with Natural Family Planning? Are we open to using NFP either to postpone pregnancy or to try to conceive? Have we taken an NFP class together? (See also, “When Can We Use NFP?”)
  • How many children do we hope to have? What are the financial, educational, or medical factors that could affect this decision? For example, how do we envision educating our children (homeschool, Catholic or private school, or public school)? Do we hope to pay for our children’s college education? Do these issues affect what we think about the number of children in our family?
  • Do we feel pressure from our parents or in-laws either to have children right away or to postpone pregnancy? How will we deal with that?
  • If we have difficulty conceiving, how would we deal with potential infertility? What if our physician confirmed that we were infertile? How would we feel? What would we do? Are we aware of what the Church teaches in regards to infertility treatments and reproductive technology?
  • Would we ever consider becoming foster parents or adopting?
  • How would we deal with an unexpected pregnancy? What would we do if our physician told us that our unborn baby was sick or would be handicapped?

Parenting

  • What did you like most about the way you were raised?
  • What would you like to change in the way you raise your own children?
  • If one of us is not Catholic, have we discussed in which faith we hope to raise our children?
